THE CORPORATION OF THE TOWNSHIP OF UXBRIDGE

NOTICE OF INTENT TO CONSIDER REMOVAL OF A HOLDING SYMBOL FROM THE ZONING BY-LAW

The Council for the Township of Uxbridge is considering an amendment to the Township Zoning By-law 81-19 for the lands shown on the Key Map which is enclosed with this notice for ease of reference. The requested change is described below:

LOT 12, PLAN 40M2336, UXBRIDGE, REGIONAL MUNICIPALITY OF DURHAM, S/T EASEMENT IN GROSS UNTIL 2026 12 08 AS IN DR568402 S/T EASEMENT IN GROSS OVER PT 6 ON PLAN 40R24690 AS IN DR607858 (45 Anderson Boulevard) 

EFFECT:                         
To remove the Holding (H) Symbol from the subject lands, which are currently zoned “Holding Rural Industrial Exception No. 36 ((H)M1-36) Zone”.

The purpose of the Holding Symbol for the M1-36 Zone is to ensure that: 

THAT the Council of the Corporation of the Township of Uxbridge shall not remove the Holding (H) Symbol from the Holding Rural Industrial Exception No. 36 ((H)M1-36) Zone on the lands which are the subject of this by-law until the following conditions have been complied with:

i.     Approval of wastewater systems by the Region of Durham;

ii.    Registration of the plan of subdivision for the lands in the M1-35, M1-36 and M1-37 Zones;

iii.   That the subdivision agreement and any other required site plan, or other development agreement respecting the lands has been fully executed by the Owner and the Township of Uxbridge;

iv.   That a subdivision agreement and any other development agreement respecting the lands has been fully executed by the Owner and the Region of Durham;

v.    That the extension of Anderson Blvd. has been constructed;

vi.   Approval by the Township of a dust management plan, including long-term dust control measures;

vii.  Approval by the Township of a detailed noise report which identifies required noise mitigation measures to mitigate impacts on adjacent residents;

viii. Approval by the Township of an outdoor illumination plan which is designed to mitigate impacts on adjacent residents;

ix.  Approval by the Township of an odour management plan designated to mitigate impacts on adjacent residents;

x.   Approval by the Region of Durham of a five year monitoring program and contingency plan for groundwater contaminants.

HOW TO COMMENT:           
Council of the Township of Uxbridge will not hear representations from the public on this matter. However, additional information relating to the proposed Township Zoning By-law Amendment can be requested to the Development Services Department at Town Hall or via email, mail or telephone from.

TAKE NOTICE that the Council for the Township of Uxbridge will consider a By-law to remove the Holding symbol pursuant to Section 36 of the Plan Act, R.S.O.1990,C.P.13, no earlier than Monday, June 26th, 2023.
