This Notice is to inform you that the Township of Uxbridge has received a Temporary Zoning By-law Amendment Application which has been deemed complete in accordance with the requirements of Section 34 of the Planning Act. The Planning Committee of the Council of the Corporation of the Township of Uxbridge will hold a statutory public meeting to make available adequate information to the public regarding, and to consider, a proposed Township Temporary By-law Amendment pursuant to Section 34 of the Planning Act, R.S.O., 1990, (5389 Regional Road 30 – Avalon Club).
The statutory public meeting will be held in a hybrid format allowing for in-person attendance or virtual viewing of the public meeting. The Township of Uxbridge will be processing the Zoning By-law Amendment as required by the Planning Act and welcome any comments that you may have.
PURPOSE OF PROPOSED TEMPORARY ZONING BY-LAW AMENDMENT:
• The purpose and effect of this application is to amend the Zoning By-law to temporarily permit the existing building to operate as a pro-shop and snack bar on the subject property, for a period of three years from May 26, 2025, to May 26, 2028.
• The subject property is designated “Oak Ridges Moraine Area” under Envision Durham, as amended. The subject property is zoned “Recreational Open Space Exception No. 13 and No. 14 (OS-13, and OS-14)” and “Environmental Protection Exception No. 33, No. 34 and No 35 (EP-33, EP-34, and EP-35)” under the Township of Uxbridge Zoning By-law No. 81-19, as amended.
LOCATION OF THE SUBJECT PROPERTY:
The subject property is located on the east side of York Durham Line (Regional Road 30) between the Wagg Road and Regional Road 8. The lands also have frontage onto Concession 2 along the eastern lot line. It is municipally known as 5389 Regional Road 30. The parcels are legally described as PT E 1/2 LTS 24 & 25, CON 1 UXBRIDGE, PT 1 40R8506; PT LTS 22 & 23 CON 1 UXBRIDGE PT 1, 40R7773; PT LT 22 CON 1 UXBRIDGE PTS 1 & 2 PL 40R-20340; and PT LT 22 CON 1 UXBRIDGE PTS 3, 4, 5, 40R1207 Township of Uxbridge, Region of Durham. This Notice is given in accordance with the requirements of the Planning Act, R.S.O. 1998, c. P.13, as amended. A final recommendation on the application will not be presented until after the Township Public Meeting and all technical comments have been received.
The applicant, a specified person (as defined by the Planning Act), a public body (as defined by the Planning Act), and a registered owner of land to which the by-law would apply, each have the ability to appeal to the Ontario Land Tribunal a decision of the Township of Uxbridge to pass a by-law in response to the application.
If a person or public body would otherwise have an ability to appeal the decision of the Council of the Township of Uxbridge to the Ontario Land Tribunal but the person or public body does not make oral submissions at a public meeting or make written submissions to Council c/o the Township Clerk at the address shown below or at deleroux@uxbridge.ca, before the by-law is passed, the person or public body is not entitled to appeal the decision.
If a person or public body does not make oral submissions at a public meeting or make written submissions to Council c/o the Township Clerk at the address shown below or at dleroux@uxbridge.ca, before the by-law was passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Land Tribunal unless, in the opinion of the Tribunal, there are reasonable grounds to do so.
